Recruitment - Terms and Conditions

1. Our Guarantee means the following:
1.1 The Client is covered in the event of the employee leaving the Client’s employment for reasons other than retrenchment or death, or if employment is terminated in accordance with any provisions of the applicable Labour law within the first 90 days. 1.2 In the event of the candidate/s leaving the employment of the Client within the first 90 days, Modena Recruitment will get a new candidate/s at no charge to the client. An Agreement will be discussed between the Recruitment Consultant and the Client, as per 1.1 above. It is the responsibility of the client to liaise with the employee with regards to termination of employment as per the applicable labour laws. 1.3 Modena Recruitment will not, directly or indirectly, approach a candidate and/or employee currently in a position placed by them with the intention of securing them alternate employment, unless the candidate has expressly indicated, of their own accord, that they are back in the market. 1.4 Our guarantee period will only be validated if an invoice is paid within thirty (30) days from receipt of invoice. Interest will be charged on overdue amounts calculated at a rate of 2% per month.
2. Contract appointments & Contract to Permanent Appointments:
2.1 Contract Fees will be calculated at 15% to 20% on monthly remuneration dependant on the length of fixed term contract. If the contract position becomes a Permanent Appointment, the Client will remain responsible for the payment of the Permanent Fee as discussed with the recruitment consultant.
3. Modena Recruitment will not accept any responsibility directly or indirectly for accidents in the workplace or work-related accidents or any damages of any nature caused by the assignee willingly or unwillingly, locally or abroad; the client indemnifies & holds “Modena” harmless against any claims whatsoever of the assignee in terms of any persons, cash, equipment, vehicles, third parties, lives of persons or the company. 4. Any potential conflict of interest will be disclosed to the client before commencement of the assignment or candidates being referred. 5. Modena Recruitment will not, directly or indirectly, charge any fees to candidates. 6. Modena Recruitment will not enter into any contracts or agreements containing any form of candidate liability clauses with candidates. Notwithstanding, Modena Recruitment may institute legal action against a candidate for damages for unlawful actions of the candidate. 7. Modena Recruitment will not share any candidate information with any third party without the express permission of the candidate unless required to do so by law. 8. Interviews will be conducted against inherent job requirements to ensure objectivity and avoid potential for unfair discrimination. Modena Recruitment will not discriminate unfairly against any candidate at any time in the recruitment process regardless of ethnic origin, colour, gender, age, religion, political opinion, nationality, social origin, sexual orientation, or any other distinguishing characteristics. 9. Any tests including, but not limited to, skills, psychometric and medical, will only be performed with the express permission of the applicant and in accordance with applicable legislation and accepted best practice. 10. Modena Recruitment will only use recognised and reputable verification agencies or institutions for any verification. Checks will be conducted within the scope of legislation and best practice, and in accordance with the agreement concluded with the client. Verified qualification and credit checks will be charged at an extra fee. 11. Modena Recruitment must be involved in the salary negotiations and the client may not negotiate a salary directly with the candidate or approach the candidate for employment directly.
